Acceptable Use Policy
Last updated 1 October 2026
Nimble answers and records real phone calls from real people, and sends messages to them on your behalf. That gives it real potential to cause harm if it is misused, so this policy sets out what you may and may not do with it.
Breaching this policy can get your account suspended. While suspended, Nimble only takes messages: it does not book or transfer calls, and does not send texts.
01Who this applies to
This Acceptable Use Policy applies to you, everyone you invite to your account, and anyone else who uses Nimble through your account. It forms part of our Terms of Service.
The short version: Nimble answers real phone calls from real people and records them. Use it to run your business honestly and lawfully, and you will never need this page.
02No unlawful use
You must not use Nimble:
- To do anything that breaches an Australian law, or the law of any other place where you or your callers are located.
- To commit, facilitate or conceal fraud, deception or a scam.
- To infringe someone else’s intellectual property, privacy or confidentiality.
- To engage in conduct that is misleading or deceptive, or likely to mislead or deceive, under the Australian Consumer Law.
- To operate a business or offer services you are not licensed or qualified to provide.
03No recording where recording is not lawful
Call recording is on by default and the receptionist plays callers a spoken recording notice. Recording is regulated by state and territory surveillance devices and listening devices laws, which differ between states.
You must not use Nimble to record calls where recording would be unlawful without consent that you have not obtained.
It is your responsibility to know what your state or territory requires and to comply with it. If you are not sure, get legal advice or turn recording off in your settings.
Specifically, you must not:
- Remove, disable, obscure or reword the recording notice so that callers are not told the call is being recorded, where notice is required.
- Configure a greeting that contradicts or undermines the recording notice.
- Use recordings for a purpose that the applicable surveillance devices law does not permit.
- Publish, broadcast or share a call recording without the consent the law requires.
- Use Nimble to record a conversation you are not a party to.
04No harassment, nuisance or spam calling
Nimble is designed to answer inbound calls to your own business line. It is not a telemarketing or outbound campaign tool.
- Do not use Nimble as part of any unsolicited outbound calling campaign.
- Do not use Nimble to make repeated, menacing, harassing or abusive contact with a person.
- Do not use Nimble to contact someone who has asked you to stop contacting them.
- Do not use Nimble in a way that would breach the Do Not Call Register Act 2006 (Cth).
- Do not route calls through Nimble to disguise the origin of a call or to evade a block.
05No unlawful SMS
Nimble sends SMS confirmations and reminders on your behalf. Those messages are subject to the Spam Act 2003 (Cth).
- Only send messages to people who have consented, expressly or by reasonable inference from their dealings with you.
- Do not use Nimble to send marketing, promotional offers or bulk messaging.
- Do not send messages that hide or misrepresent who they are from.
- Stop messaging anyone who asks you to.
- Do not harvest numbers from calls for any purpose other than serving that customer’s job.
06No impersonation
You must not configure or use Nimble to:
- Impersonate a real named individual, or claim the receptionist is a specific real person who is not employed by you.
- Impersonate another business, a government agency, a regulator, an emergency service, a bank, a utility or an insurer.
- Claim licences, insurance, accreditations, qualifications or affiliations that your business does not hold.
- Pretend to be a Nimble employee or to be speaking on behalf of Nimble.
- Create the impression that a caller has reached an organisation other than your business.
You may give the receptionist a persona and a name — that is the point of the product — but it must be clear the caller has reached your business, and you must not deny that the caller is speaking to an automated system if they ask directly.
07No emergency or high-risk use
Nimble is an automated system that can fail, mishear or be unavailable. You must not use it as:
- An emergency line, a triage line, or a monitored after-hours safety line where a delayed or missed call could cause harm.
- A channel for giving medical, legal or financial advice.
- The sole point of contact for anything where getting it wrong would endanger someone.
Anyone in an emergency should call 000.
08No scraping, reselling or redistribution
- Only ask Nimble to scan a website you own or are authorised to use. Do not point the scanner at a competitor’s site or anyone else’s content.
- Do not scrape, crawl or bulk-extract data from the Nimble app by automated means outside the documented interfaces.
- Do not resell, sublicense, white-label or otherwise commercialise Nimble or its output without our written agreement.
- Do not sell, trade or supply call recordings, transcripts, caller phone numbers or customer records to a third party as a data product, or for marketing or list-building.
- Do not use Nimble, its output or your call data to train or fine-tune a competing product or model.
09No circumventing limits or security
- Do not attempt to exceed, evade or disable plan limits, rate limits, quotas or usage metering.
- Do not open multiple accounts to get around a limit, a suspension or a price.
- Do not share one account across businesses that should each hold their own.
- Do not probe, scan or test the security of Nimble or our providers’ systems without our prior written permission.
- Do not attempt to access another account’s calls, recordings, transcripts or customers.
- Do not reverse engineer, decompile or attempt to extract the models, prompts or source code behind the service, except where the law says we cannot stop you.
- Do not introduce malware, or interfere with or overload the service or the networks it depends on.
10No misuse of the AI
- Do not use prompts, greetings or knowledge base content designed to make the receptionist produce unlawful, hateful, harassing, sexual or deceptive content.
- Do not attempt to bypass the safety controls of the underlying AI models.
- Do not load the knowledge base with false claims about your business, your pricing or your qualifications.
- Do not use Nimble to generate content that would breach the terms of the AI providers we rely on.
11Look after your account
- Keep your password confidential and do not share logins — invite team members instead.
- Remove access promptly when someone leaves your business.
- Only forward phone numbers you own or control.
- Tell us promptly at support@nimbleai.com.au if you think your account has been compromised.
12What happens if you breach this policy
If we reasonably believe you have breached this policy, we may take any of the following steps, in proportion to how serious the breach is:
- Contact you and ask you to fix the problem.
- Disable a specific feature — for example, turn off SMS or recording on your account.
- Apply limits to your usage.
- Suspend your account. While suspended, Nimble takes messages for you but does not otherwise answer, book or transfer calls, and does not send texts.
- Terminate your account under the Terms of Service.
Where it is reasonable to do so, we will give you notice and a chance to fix the problem first. Where the breach is serious, unlawful, or creates a risk of harm to another person or to our providers, we may suspend immediately and without notice.
We may also report conduct to law enforcement or a regulator where we are required to, or where we reasonably believe it is necessary.
Suspension for breach does not entitle you to a refund of fees already paid, except where the Australian Consumer Law requires one.
If you think we have suspended your account in error, email support@nimbleai.com.au and we will review it.
13Reporting misuse
If you believe someone is misusing Nimble — including recording calls unlawfully, impersonating a business, or sending spam — report it to support@nimbleai.com.au. Tell us what happened, the phone number involved and when it occurred, so we can investigate.
14Changes to this policy
We may update this policy as the product, the risks and the law change. The date at the top of this page shows when it was last updated. If a change materially affects how you may use Nimble, we will give you notice by email or in the app before it takes effect.
